Sendee – Terms of Service

Welcome to Sendee! These Terms of Service (“Terms”) govern your access to and use of Sendee, Inc.’s (“Sendee,” “we,” “us,” or “our”) website, applications, products, and services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old to use the Services. 

2. Definitions

“Capture Zones”

“Capture Zones” means any outdoor recreational, commercial, or test location where Sendee is authorized by the property owner, operator, or controlling entity to install or operate cameras, whether temporarily or permanently. Capture Zones may include ski resorts, recreation venues, event spaces, training environments, temporary pilot sites, and other locations where Sendee has permission to conduct video capture activities.

This definition ensures these Terms apply to all authorized filming environments without naming specific land types (e.g., parks).

3. Description of the Services

Sendee provides software, algorithms, and applications that allow users to:

The Services may include temporary tests, pilot deployments, or early access programs, and may involve integrations with resorts, event operators, or other property owners.

GPS-Based Tracking. To associate you with your generated clips, Sendee uses location data collected during your session, either through Strava (via a connected third-party account) or through Sendee's own mobile application, depending on availability at your Capture Zone. If you connect a Strava account, you authorize Sendee to access your session's GPS data for the purpose of matching your location to camera footage; Sendee does not access other Strava account data beyond what is needed for this purpose. Your Strava authorization token is encrypted and stored securely, and you may disconnect your Strava account at any time through your Sendee account settings.

We may update, modify, or discontinue parts of the Services at any time.

5. Incidental Capture of Individuals

Sendee’s camera systems may capture incidental footage of individuals present in Capture Zones. Incidental capture is normal and expected in outdoor recreational environments.

By using the Services, you acknowledge and accept that:

Sendee's geofencing and clipping systems are designed to minimize incidental bystander capture, but cannot guarantee bystanders will never appear in generated footage.

6. Consent in Capture Zones

Filming within Capture Zones is governed by the rules, waivers, permissions, and notice mechanisms established by the property owner or operator authorizing Sendee’s deployment at that location. This may include posted signage, liability waivers, photo/video releases, or other required notices under local law.

By entering a Capture Zone or using the Services, you agree to be filmed consistent with the rules applicable to that specific location. Some Capture Zones may be located on lands managed by federal or state agencies (such as the U.S. Forest Service) under authorization held by the property operator. Sendee operates within such locations pursuant to authorization.

6A. Test Locations and Pilot Deployments

From time to time, Sendee may operate cameras in temporary test locations or pilot environments where Sendee has received authorization to conduct filming.

Where required by the property owner or applicable law, Sendee will provide reasonable notice (e.g., signage or digital disclosure) indicating that video capture is occurring.

Individuals entering such areas may appear incidentally in testing footage. Sendee is not responsible for individuals who enter a filming area without reviewing posted notices.

7. User Responsibility for Sharing Content

You are solely responsible for any content you choose to:

8. Personal, Non-Commercial Use

Videos generated by Sendee are intended for personal, recreational use only. If you wish to use content for commercial purposes, you must independently obtain appropriate rights from identifiable individuals appearing in the footage.

9. Capture Zone Operator Responsibilities

Sendee and the property owner or operator authorizing filming at a location share responsibility for a safe and compliant deployment, as follows:

In temporary test environments, signage and notices will be provided by Sendee only to the extent required by the authorizing property owner or applicable local regulations.

Sendee relies on property owners/operators to meet their obligations and is not responsible for their failure to do so.

10. Indemnification for Location-Based Filming

To the fullest extent permitted by law, you agree that Sendee is not liable for claims arising from:

11. Prohibited Conduct

12. Intellectual Property

All Sendee software, algorithms, interfaces, visual design, trademarks, and content are owned by Sendee or its licensors. You may not copy, distribute, modify, or create derivative works without written permission.

13. Third-Party Links and Integrations

The Services may include links or integrations with third-party services or property operators. Sendee is not responsible for third-party content, policies, or practices.

This includes Sendee's integration with Strava for GPS tracking. Your use of Strava is governed by Strava's own terms and privacy policy, which Sendee does not control.

14. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind. Sendee does not guarantee:

Outdoor recreation activities carry inherent risks. Sendee is not responsible for injuries, accidents, or incidents occurring in Capture Zones.

15. Data Retention

Sendee retains video clips and raw capture footage as follows:

Raw Video. Raw footage captured by Sendee's camera systems is stored in our encrypted database for 7 days, then deleted from the system. Sendee may apply compression to raw footage when no person is detected in the frame.

Non-Purchased Video Clips. Video clips that have been generated but not purchased are saved for 30 days until deleted. This applies where a user has signed up for Sendee and logged a “Session,” but has not purchased the resulting clips. We will not provide advance notice prior to deletion of unpurchased clips.

Purchased Clips. Purchased video clips are saved in a user's profile in perpetuity and are only ever accessible by the user. You may request deletion of purchased clips at any time by contacting us at the address in §20.

Deletion Requests. Users may request deletion of their clips at any time by contacting us at the address in §20. Deletion requests for purchased clips will be processed within 30 days.

16. Limitation of Liability

To the maximum extent allowed by law:

We may suspend or terminate the Services or your access to them at any time. Upon termination, access to certain content may discontinue, and sections related to liability, IP, and indemnification will survive.

19. Modifications

We may update these Terms at any time. Your continued use of the Services after changes means you accept the updated Terms.

20. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. To the extent any provision of these Terms conflicts with applicable California consumer protection law, including the California Consumer Privacy Act (CCPA), California law shall control with respect to California residents.
